THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI Civil Revision Petition No.2698 of 2015 ORDER:

When the revision was taken up for hearing on 21.03.2016 there was no representation for the revision petitioner and the learned counsel for the 1st respondent was present. Therefore, the matter was directed to be listed on 29.03.2016. When the revision was listed on 01.04.2016, the matter was directed to be listed after two weeks. When the matter was listed on 08.06.2016, there was no representation for the revision petitioner and the learned counsel for the 1st respondent was present. As there was no representation for the revision petitioner on earlier occasions, that is, on 21.03.2016 and also on 08.06.2016, the revision was directed to be listed on 10.06.2016 under the caption 'for Dismissal'. From that day the revision is being listed under the caption 'For Dismissal'. When the revision is taken up for hearing today, the learned counsel appearing for the 1st respondent is present. The learned counsel for the revision petitioner is not present. On his behalf, Sri Ram Singh, advocate sought time.

The learned counsel for the 1st respondent would point out that taking advantage of an earlier order dated 25.07.2014 of this Court passed in CRP.no.2353 of 2014 a misrepresentation was made and the fact that the aforementioned CRP was closed on 01.08.2014 is not brought to the notice of this Court and that an interim order was obtained from this Court in the present CRP on 14.07.2015. He would further submit that the order assailed in the present CRP is the very same order assailed in the aforesaid CRP, which was closed.

A copy of the order dated 01.08.2014 in the aforementioned CRP.no.2353 of 2014 is produced before this Court. This Court finds no reason to grant further time as sufficient time is already granted.

In the result, the Civil Revision Petition is dismissed for default. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this revision shall stand closed.
