THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION No.11460 OF 2009 ORDER:

The prayer sought for in the writ petition is as under: "to issue an order direction or writ more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in not providing the petitioners with rehabilitation under the A P Mission for Eradication of Manual Scavenging and Rehabilitation of Scavengers, G.O.Ms. No. 83, Social Welfare (POA) dept., dated 4/9/2001 inspite of their applications being pending for more than two years amounts to arbitrary and unlawful, dereliction of duty and further direct them to forthwith provide such rehabilitation in consultation with the petitioners."

The learned counsel appearing for the petitioners placed on record the proceedings of the 2nd respondent dated 09.01.2013 addressed to the Branch Managers of Canara Bank, Bank of India & Corporation Bank, Ongole whereby the 2nd respondent asked the said Banks to send the consent letter to the office of the 2nd respondent for sanction of loans in favour of petitioner Nos.2,7,9,10 and 16 to 20 so that the 2nd respondent would sanction certain subsidies for the schemes mentioned thereunder. Basing on the said proceedings, the learned counsel for the petitioners submits that since the other petitioners are similarly situated with that of the above mentioned petitioners, the 2nd respondent may be directed to extend the said benefit to the remaining petitioners also.

Considering the facts and circumstances of the case, the 2nd respondent herein is directed to consider the case of the remaining petitioners for providing similar benefits that were already

extended to the petitioner Nos.2,7,9,10 and 16 to 20, if they are eligible.

Accordingly, the writ petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed. ________________________ T. AMARNATH GOUD, J 27th DECEMBER 2018.
