The Court made the following:

ORDER:

This writ petition is filed for a mandamus to declare the letter/proceedings in Ref.No.C/236/2014, dated 13.01.2016, of respondent No.4 permitting respondent No.5 to issue orders to the technical experts to enter the orders from 17.01.2016 for selling the ordinary sand in respect of the reaches shown in the said letter as conflicting to the New Sand Policy, 2016 issued under G.O.Ms.No.20, Industries and Commerce (MII) Department, dated 15.01.2016, besides being illegal and arbitrary. At the hearing, the learned Assistant Government Pleader for Mines and Geology (AP) appearing for respondent No.3, has placed before the Court, a copy of proceedings in Ref.No.C/236/2014, dated 01.02.2016, of respondent No.4 addressed to respondent No.5, wherein it is informed that all the sand reaches mentioned therein have been closed with effect from 31.

01.2016 and that no digging and sale of sand are taking place within the purview of any of the maxes within the District. Mr.V.Sudhakar Reddy, learned counsel for the petitioner, has submitted that in view of the aforesaid proceedings, no further adjudication of the writ petition is necessary.

Hence, the Writ Petition is disposed of as infructuous. As a sequel to disposal of the writ petition, W.P.M.P.No.3400 of 2016 filed by the petitioner for interim relief shall stand disposed of as infructuous. ______________________________ C.V.NAGARJUNA REDDY, J 03rd February, 2016 GHN
