THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13537 OF 2025 ORDER :

This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by the petitioners/A.1, A.3 and A.4 seeking anticipatory bail in connection with Crime No.386 of 2025 of Chatrinaka Police Station, Hyderabad. The offences alleged against the petitioners are under Sections 108 & 85 of Bharatiya Nyaya Sanhita, 2023. 2.

The facts of the case are that a complaint was lodged on 04.09.2025 against the accused by the complainant stating that her daughter, A. Meghana, aged 20 years, had married Suman Reddy, aged 35 years which was a love marriage about six months earlier. However, the couple frequently quarreled and separated within 20 days, after which Meghana returned to her parents' home and lodged a complaint against her husband at the Women Police Station, Charminar. Her parents then decided to arrange her re-marriage. A week prior to the incident, Suman Reddy's mother Neelamma, his relative Anji Reddy, and his brothers Sandeep and Sashi repeatedly called the complainant Sujatha, threatened her and questioned about the remarriage plans. They also threatened to publicly share Meghana's

- 2 - wedding photos to prevent her from marrying again. Meghana became emotionally disturbed and upset and on 04.09.2025 at about 3:30 PM, her room was found locked from the inside and when the door was broke open, she was found hanging from the ceiling fan with a saree. She was immediately shifted to Esra Hospital and then referred to Gandhi General Hospital, where doctors declared her dead. Based on the said complaint, the police registered a case against the accused. 3.

Heard Sri Muneer Bassha Shaikh, learned counsel for the petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.

The contention of learned counsel for the petitioners is that the deceased Meghana and the second son of petitioner No.1 were married on 04.04.2025 at Aarya Samaj as it was a love marriage, they lived happily for a period of 20 days and on 25.04.2025 when the deceased went to her college to attend Degree final year exam the husband of deceased went to pick up her, the complainant and sister of deceased came to the college and forcibly took her with them, a quarrel also took place and the police of Narayanaguda Police station conducted counseling and convinced the husband of deceased to send deceased to her parents home for 15 days. He further contended that there are

- 3 - no specific allegations against the petitioners who are motherin-law and brothers-in-law of the deceased in the complaint. The incident took place at the house of the parents of deceased after five months of deceased leaving her matrimonial home and that the deceased committed suicide due to the unbearable pressure from her parents for re-marriage. The petitioners are no way connected with the alleged offence and hence, prayed this Court to grant bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that the allegations against the petitioners are serious in nature. The deceased died because of the harassment of petitioners. Hence, prayed to dismiss this bail application.

Having regard to the submissions made and the material on record, the allegations against the petitioners are that due to the abetment of these petitioners, the deceased committed suicide and died, whereas the averments itself shows that the deceased left her matrimonial home five months prior to the incident and there is no immediate contact by these petitioners with the deceased. The husband of the deceased is not made as accused in this case but his relatives are shown as accused.

- 4 - Considering the allegations and facts and circumstances of the case, this Court deems it fit to grant bail to the petitioners subject to the following conditions :

i.

The petitioners/A.1, A.3 and A.4 shall surrender before the Station House Officer, Chatrinaka Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on their executing a personal bond for Rs.25,000/- (Rupees Twenty five Thousand only) each with two sureties, for the like sum each.

ii.

The petitioners/A.1, A.3 and A.4 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioners/A.1, A.3 and A.4 shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with the Investigating Officer in investigating the case. 7.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
