Learned counsel for the petitioner states that the impugned order in the present writ petition has been challenged in WP.No.24170 of 2008 and the same is allowed by this Court on 25.03.2009.

Heard learned Assistant Government Pleader for Revenue.

Though petitioner asserted in the writ affidavit about allowing of WP.No.24170/2008 by this Court on 25.03.2009, nothing is stated about the same in the counter affidavit. A perusal of the order dated 25.03.2009 passed by this Court in WP.No.24170 of 2008 goes to show that the same is filed by some other effected persons by the present impugned order and that the lis in the present writ petition is squarely covered by the said order.

In view of the above, the writ petition is allowed in terms of the order dated 25.03.2009 passed by this Court in WP.No.24170 of 2008 holding that the land in Survey No.602 of Proddatur Town, shall be treated as patta land and the 3rd respondent shall entertain the sale deeds that may be

presented by the petitioner, without reference to any prohibition contained under any enactment vis-à-vis the said land. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 03.01.2017 t k.
