THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12206 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 to 4 in C.C.No.202 of 2023 on the file of I Additional Judicial Magistrate of First Class, Jagtial, registered for the offence under Section 420 of IPC and Section 66 (c) and 66 (d) of I.T.Act.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State and perused the record.

Learned counsel appearing for the petitioners would submit that the petitioners have nothing to with any kind of fraud that was committed by calling people. They are residents of Jharkand and the Police have implicated them falsely in the case. They are languishing in jail from 13.01.2023. 4.

On the other hand, learned Additional Public Prosecutor submits that there are several cases against these petitioners.

Keeping in view that petitioners are in jail for more than 11 months, they can be granted the relief of regular bail, subject to following conditions:- i) The petitioners/Accused Nos.1 to 4 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties i.e., one local surety and the other from the native place, for a like sum each to the satisfaction of the I Additional Judicial Magistrate of First Class, Jagtial.

ii) The petitioners/Accused Nos.1 to 4 after release shall appear before the concerned Court on every date of hearing.

iii) The petitioners/Accused Nos.1 to 4 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
