THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN Contempt Case No.253 of 2013 ORDER:

This Contempt Case is filed alleging violation of the order passed by this Court in W.P.No.35334 of 2012 dated 12.12.2012. The said order was passed on a concession made across the Bar by the learned Government Pleader appearing on behalf of the learned Advocate General. In view of the concession, the 2nd respondent (District Collector, Guntur) was directed to delete the petitioner's patta land of an extent of Ac.1.50 cents in Chowdavaram Village, Guntur District from the list of assigned lands prepared under Section 5(1) of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Ac, 1977 within two weeks. This Court made it clear that the said order did not preclude the respondents from availing such other remedies as were available to them in law against the order passed this Court earlier in W.P.No.18594 of 2012 dated 23.07.2012.

Along with the counter affidavit, the respondent has enclosed a copy of the proceedings issued by the Revenue Divisional Officer dated 07.02.2013 deleting the subject land from the list of assigned lands, subject to the outcome of the judgment in Review Petition No.50089 of 2012 filed before the High Court. The submission of Sri P.Roy Reddy, learned counsel for the petitioner, is that the Review Petition was dismissed on 21.03.2013.

The aforesaid order dated 07.02.2013 was passed before the order was passed in the Review Petition on 21.03.2013. It is not in dispute that, on the said order dated 07.02.2013 being passed, the aforesaid order of this Court has been complied with. The subsequent event of the Review Petition being dismissed is, therefore, of no consequence.

The Contempt Case is, accordingly, closed. The Contempt Applications, pending, if any, shall also stand closed. There shall be no order as to costs.
