THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 40012 of 2015 ORDER:

The grievance of the petitioner was that the Station House Officer, Suryapet Rural Police Station, Nalgonda District, was not acting in accordance with law in filing a seizure report before the learned Judicial First Class Magistrate, Suryapet, in Crime No.232 of 2015 in relation to his lorry bearing registration No. TN 30 AQ 8114.

Written instructions dated 15.12.2015 were furnished by the Sub Inspector of Police, Suryapet Rural Police Station, Nalgonda District, to the Office of the learned Government Pleader for Home wherein he stated that Crime No.232 of 2015 had been registered under Section 379 I.P.C read with Section 3 of the Prevention of Damage to Public Property Act, 1984 upon apprehending the lorry bearing registration No.TN 30 AQ 8114 loaded with sand. Thereafter, upon being informed by the Assistant Director of Mines and Geology, Suryapet, that the owner of the lorry had paid the requisite penalty under receipt No.057643 dated 11.12.2015 and as the Regional Transport Officer, Suryapet, and the Commercial Tax Officer, Suryapet, had also informed the police authorities that necessary taxes had been collected from the owner of the vehicle, the vehicle was released under acknowledgment dated 11.12.2015 given by the petitioner.

In the light of the aforestated developments, the cause in this Writ Petition no longer survives for consideration.

The Writ Petition is accordingly closed.

Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
