THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION NO.69 OF 2015 ORDER: (per the Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) This writ petition has been filed for issuance of Writ of Mandamus for taking action against the persons who are responsible for issuing allegedly fake pass books and also for initiating criminal cases against individuals who are responsible in connection with First Information Report (FIR) Nos.192, 193, 199 and 195 dated 15.09.2008, 25.09.2007 and 28.11.2008 respectively, of Tanguturu Police Station. It is not in dispute that the petitioners did not lodge any FIR and the FIRs were lodged by some other persons 7 or 8 years ago. We are of the view that at the instance of the petitioners we cannot take action in this matter simply because by this time investigation must have been completed by the Police in connection with the aforesaid FIRs. The persons who lodged the FIRs have locus to approach the authority concerned in the event any inaction is found on the part of the Police.

Hence, the writ petition is dismissed with the aforesaid observations.

Pending miscellaneous petitions, if any, shall also stand dismissed. There will be no order as to costs. ________________________ K.J. SENGUPTA, CJ
