THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38425 of 2016 ORDER:

This writ petition is filed seeking to declare the proceedings in Crime No.257 of 2016, dated 29.10.2016, for an offence under Section 379 IPC, Section 21(1) of MMDRA, Section 3 of PDPPA on the file of the 2nd respondent insofar as the petitioners are concerned, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioners is that the petitioners are owners of the vehicles bearing Nos.AP 22 W 1622 - Tractor and AP 22 W 1623 - Trailor and AP 22 W 8397 - Trailer. The main grievance of the petitioners is that one M. Gopal lodged a complaint on 29.10.2016 with the 2nd respondent alleging that the above said vehicles are involved in theft of sand and the same was registered as Crime No.257 of 2016.

Considering the grievance of the petitioners, the 2nd respondent is directed to complete the investigation in Crime No.257 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioners. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 9th November, 2016 KL
