IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) FRIDAY, THE SIXTH DAY OF FEBRUARY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION Nos.1698 AND 1703 of 2015 BETWEEN V.Srinivasa Rao and another ... PETITIONERS AND The State of Andhra Pradesh, Rep. by its Principal Secretary, A.P. Secretariat Building, Hyderabad and others.

...RESPONDENTS The Court made the following:

COMMON ORDER:

Heard.

2. Learned Government pleader has received instructions. But, however, it is apparent that the Joint Collector, Vizianagaram, has passed confiscation order dated 12.01.2015, directing 30% of the value of the seized stocks to be confiscated and the petitioners were directed to be careful in future.

3. Since the petitioners' authorization and licence are not interfered with except directing the said 30% of the value of the seized stocks to be confiscated, there is no reason why the essential commodities are not supplied to the petitioners' shop.

4. Hence, respondent No.4 shall verify whether petitioners' authorization and licence is in force and if so, supply the essential commodities to the petitioners in terms of the licence as against the payment of the value of the stock by way of D.D. as per usual terms.

Writ petitions are, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
