THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.11438 of 2009 ORDER:

The petitioners challenge the order dated 30-07-2008 in M.P.No.24 of 2003. Through the order impugned in the writ petition, the Labour Court directed the petitioners herein to pay Rs.18,771-30 ps. to 2nd respondent within a period of two months along with 18% interest from the date of retirement of the 2nd respondent i.e., 1-8-1996 till the final and actual payment is made.

The writ petition is dismissed for default against 2nd respondent for non-compliance of conditional order, dated 12-12-2012. After lapse of three and half years, it appears that no steps are taken to rectify the defect. Since the writ petition is dismissed against the contesting respondent, the prayer cannot be considered. Accordingly, the writ petition is dismissed. It is open to the petitioner, if so advised, to file appropriate petitions for restoration as well as setting aside the default order against 2nd respondent. No order as to costs.
