THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.13387 OF 2025 ORDER :
This criminal petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, by petitioners/A.1 and A.4 seeking anticipatory bail in connection with FIR No.1291 of 2025 of Vanasthalipuram Police Station, Rachakonda. Initially the offences registered against the petitioners are under Sections 118(1), 329(4), 74, 324(4), 352, 351 (2) r/w.3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS') thereafter after recording the statements the sections were altered to Sections 109, 332(b), 74, 324(4), 352, 351(2) r/w.3(5) of BNS.

The facts of the case are that on 08.09.2025 at about 02.00 hours a complaint was lodged by the complainant stating that on the same day at about 00:30 hours, while he, Eragadindla Saidulu, and Vemula Raju (S/o.Satyam) were standing on their penthouse, Sai, Palle Raju, Dhoni, and others allegedly trespassed into their residence and attacked them with iron rods, beer bottles, sticks, and stones. When the women of their family intervened to stop the altercation, they too were assaulted. As a result, he, Eragadindla Saidulu, and Vemula
- 2 - Raju sustained bleeding head injuries, while Shankar suffered injuries to other parts of his body. During the incident, the attackers also caused damage to the house and to nearby vehicles including cars, autos, and bikes. They later expressed that they feared for their lives due to threats from the assailants. Upon further inquiry, he got to know the other persons involved are Shiva Chekka, Dhanapur Pavan, and others as such requested the police to take necessary action against the said persons basing on which the police registered the case against the accused for the above offences. 3.
Heard Sri Rajashekhar Reddy Jejala, learned counsel for the petitioners and Sri D.Arun Kumar, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The contention of learned counsel for the petitioners is that A.1 filed criminal case against complainant and to get compromise in the said case filed the present case with false and baseless allegations. It is further submitted that there is no intention for the petitioners to kill the complainant or any other injured persons. The injured suffered only simple injuries and only to get compromise the case filed by A.1 the sections were altered. A.2 and A.3 in this case are already arrested and
- 3 - released on bail. Hence, prayed this Court to grant anticipatory bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed bail on the ground that alleged offences against the petitioners are serious in nature. The injured sustained grievous injuries as such, section was altered. Hence, petitioners are not entitled for bail and prayed to dismiss this petition.

Considering the submissions made by both the counsel and the material on record, the specific allegations against these petitioners are that Sai, Palle Raju, Dhoni and some other persons went to the house of complainant and attacked with iron rods whereas injury certificate submitted by prosecution shows that the injured sustained only simple injuries. There is a case and counter case filed by the accused and complainant against each other. In another crime registered against the complainant, SC/ST Act is also included. As such, considering the facts and circumstances and as there are cases and counter cases between the parties, this Court deems it fit to grant anticipatory bail to the petitioners subject to the following conditions :

The petitioners/A.1 and A.4 shall surrender before Station House Officer, Vanasthalipuram Police Station, Rachakonda within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioners on bail on their executing a personal bond for Rs.25,000/- (Rupees Twenty five Thousand only) each with two sureties, for the like sum each.
ii.
The petitioners/A.1 and A.4 shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight
(8) weeks, for the purpose of investigation and thereafter, as and when required.
iii.
The petitioners/A.1 and A.4 shall abide by the other conditions stipulated in Section 482(2) of BNSS and co-operate with Investigating Officer in investigating the case. 7.
Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
