THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.10085 of 2015 ORDER:

This Criminal Petition is filed by the petitioner - accused No.1, under Section 438 of the Code of Criminal Procedure, seeking to grant bail in Crime No.177 of 2015 of Agiripalli Police Station, Krishna District, registered for the offences punishable under Sections 306 and 420 read with 34 IPC. Heard and perused the material available on record. The case of the prosecution is that the husband of the de facto complainant and her daughter and son-in-law took a loan of Rs.3,20,000/- from the petitioner through the other accused by mortgaging the land given to their daughter as pasupu kunkuma. Thereafter, when they want to repay the same, the petitioner demanded an amount of Rs.

32,00,000/- to give their land and harassed threatened the husband of the de facto complainant to pay the said amount, due to which the husband of the de facto complainant committed suicide by consuming poison. Learned counsel for the petitioner submitted that there are civil disputes pending between the parties and admittedly, the daughter of the de facto complainant sold the subject property to the petitioner and due to the hike in prices of land, they hatched a plan to grab the subject property. Considering the said facts and circumstances, this Court is of the view that grant of anticipatory bail to the petitioner would not cause any prejudice to the investigating agency and hence, this Court is inclined to grant anticipatory bail to the petitioner.

In the circumstances, the petitioner - A1 is directed to surrender before the Magistrate concerned, on or before 21.10.2015 and on such surrender, he shall be

released on bail on his executing a personal bond for a sum of Rs.20,000/- (Rupees twenty thousand only) with one surety for the like sum to the satisfaction of the said Magistrate. Further, the petitioner is directed to appear before the Station House Officer concerned, daily between 10 a.m. and 5 p.m., for a period of (10) days. Accordingly, the Criminal Petition is allowed. ______________ RAJA ELANGO, J October 07, 2015.
