THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION Nos.15304 and 29617 of 2018 COMMON ORDER:

Since these two Writ Petitions are inter-related, this Court deems it appropriate to dispose of the Writ Petitions, by way of this Common Order.

In W.P.No.29617 of 2018, the petitioner challenges the action of the 2nd respondent in not considering his application for shifting of M/s.G.R.Wines situated at D.No.4/1-690-A, Nellore Road, Badvel, YSR Kadapa District. It is also his case that he made an application on 12.04.2018, but no action has been taken. 3.

In W.P.No.15304 of 2018, the petitioner is opposing the said shifting proposal said to have been made by the petitioner in W.P.No.29617 of 2018.

Today, when the matter is taken up, Written Instructions furnished by the Prohibition and Excise Superintendent, Proddutur, are placed on record by the learned Government Pleader and according to which, till today, the Office of the Prohibition and Excise Superintendent has not received any application for shifting of the licenced premises of M/s.G.R.Wines. 5.

On hearing the same, a request is made by the learned Counsel for the petitioner in W.P.No.29617 of 2018 that the petitioner may be permitted to make an appropriate application before the respondents for redressal of his grievance and the same may be directed to be considered by the respondents, strictly in accordance with law.

On the other hand, learned Counsel appearing for the petitioner in W.P.No.15304 of 2018 submits that the petitioner in

the said Writ Petition filed objections on 10.04.2018 opposing the shifting of M/s.G.R.Wines.

Having heard the learned Counsel appearing for the petitioners in both the Writ Petitions and also the learned Government Pleader for the respondents, this Court deems it appropriate to dispose of the Writ Petition, keeping it open for the petitioner in W.P.No.29617 of 2018 to submit an appropriate application to the competent authority with a request for shifting, within a period of two weeks from the date of receipt of a copy of this Order and if any such application is filed by the petitioner in W.P.No.29617 of 2018, within the time stipulated above, the same be considered and appropriate action be taken, strictly in accordance with law, after considering the objections, dated 10.04.2018, submitted by the petitioner in W.P.No.15304 of 2018, as expeditiously as possible.

Miscellaneous Petitions pending consideration, if any, in this Writ Petition shall stand closed. There shall be no order as to costs.
