THE HON'BLE SMT. JUSTICE LALITHA KANNEGANTI WRIT PETITION No.41291 of 2022 O R D E R:

The writ petition is filed seeking the following relief: "... to issue any writ order or direction more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondent Nos.2 to 4 in taking action against the illegal constructions being carried out by the 5th respondent in front of the House bearing No.9-1-37/5, admeasuring 250 sq.yds situated at Langur house by occupying the existing public road on eastern side pursuant to complaint dt.1-6-2022 as illegal, arbitrary and unconstitutional and consequently direct the respondents No.2 to 4 to demolish the illegal rooms constructed by the 5th respondent towards eastern side of the in front of the House bearing No.9-1-37/5 admeasuring 250 sq.yds situated at Langur House by occupying the existing public road on eastern side pursuant to complaint dt.1-6-2022 and ....".

Mr. Rajagopallavan Tayi, learned counsel for the petitioner submits that the petitioner gave a representation to the respondents on 01.06.2022 stating that the unofficial respondent is making construction contrary to the sanction plan and in spite of the said representation, no action has been initiated by the respondents. 3.

Mr. K. Siddhardh Rao, learned standing counsel for the respondent municipality submits that they will consider the representation of the petitioner and pass appropriate orders. 4.

Recording the said submission of learned standing counsel, the writ petition is disposed of directing the respondents to consider the representation dated 01.06.2022 of the petitioner and pass

appropriate orders in accordance with law, within a period of six (6) weeks from the date of receipt of copy of the order, by issuing due notice to the unofficial respondent. This court is not proposing to issue notice to the unofficial respondent as the respondents are directed to give an opportunity to the unofficial respondent. There shall be no order as to costs.

The Miscellaneous Applications, if any shall stand automatically closed.
