HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 2427 of 2017 Order:

This Writ Petition was filed challenging the action of the second respondent in calling the petitioner to the police station and forcing him to settle the issue with the third respondent in relation to civil dispute pending between them.

Learned Government Pleader, on the basis of written instructions, submits that based on the complaint of the third respondent a case was registered in Crime No.10 of 2017 on the file of Tadepalli Police Station, Guntur Urban district against the petitioner and another and the investigation is under progress. During the course of investigation, the complainant and two witnesses were examined and their statements were recorded. However, with regard to allegation against the respondents 2 and 3, it is stated that they never threatened the petitioner to settle the matter with the third respondent. It is also denied that since 19.01.2017 the second respondent was calling the petitioner to his office and threatening to remove the compound wall and gate. The pendency of the civil dispute is admitted.

He also stated that due to mala fide intention false allegations were levelled against the second respondent. Recording the said statement made by the learned Government Pleader, the Writ Petition is closed. However, it is made clear that during the process of investigation the official respondents shall follow due process of law and shall not harass the petitioner. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
