8ikhoTHE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA Writ Petition No.17942 of 2008 ORDER: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Both Sri V.Bhaskar Reddy, learned counsel for the petitioner, and Sri Shaik Jeelani Basha, learned Special Standing Counsel for Commercial Taxes, would agree that the subject matter of this writ petition is covered by a judgment of the Supreme Court in State of Karnataka vs. Pro Lab1.

The impugned order is, therefore, set aside and the matter is remanded to the assessing authority to pass a fresh order, in terms of the judgment in Pro Lab1, after giving the petitioner an opportunity of being heard.

The Writ Petition is disposed of accordingly. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
