ORAL ORDER:

Alleging that respondents 3 to 5 are dismantling the existing house of petitioner without following due process, this writ petition is filed. This Court by order dated 12.9.2016 directed the respondents not to change the physical features of the property of the petitioner by laying the road without following the due process of law.

Learned standing counsel for respondents, on instructions, submitted that road is already formed and petitioner's property is not affected in the formation of the road. He further submitted that petitioner's house is not abetting the road and there is a house of some other person in between the road and petitioner's house.

In view of the above submissions, no further orders are required to be passed. However, it is needless to observe that if for any reason, property of the petitioner is required by municipal corporation, they shall follow the due procedure of law before evicting the petitioner from the property. Accordingly, writ petition is disposed of. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. ______________ P NAVEEN RAO,J DATE:29.11.2016 TVK
