HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE N. BALAYOGI Writ Petition No.12151 of 2017 ORDER: (V. Ramasubramanian, J) The petitioner, who was appointed as Special Judicial Magistrate of Second Class on contract basis, has come up with the above writ petition challenging an order of suspension.
2. Heard the learned counsel for the petitioner and Mrs.Bobba Vijayalakshmi, learned standing counsel for the respondent.
3. Nothing survives for adjudication in this writ petition, since a recommendation has already been made to the Government for terminating the services of the petitioner. The Government is yet to issue orders. In view of the said recommendation, a fresh notification was issued for filling up the post and the petitioner also seems to have applied. Therefore, the question of dealing with the correctness of the order of suspension at this stage does not arise.
4. Accordingly, the writ petition is dismissed with liberty to the petitioner to challenge the termination order if any passed. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
