THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10883 of 2016 ORDER:

The prayer of the petitioner in this case is as under: "It is therefore prayed that this Hon'ble High Court may be pleased to grant appropriate direction more in the nature of Writ of Mandamus declaring the action of the Respondent in not issuing social status certificate i.e. BC-D at Sl.No.19 (Mudiraju Community) in pursuance of the representations made by the petitioner dt.13.09.2014, 11.08.2014 and 24.02.2014 as arbitrary, illegal, discriminatory, malafide violating Article 14, 16 and 21 of the constitution of India and issue consequential directions directing the Respondents to issue social status certificate i.e. BC-D at Sl.No.19 (Mudiraju Community) in considering and disposing the representations made by the Petitioner dt. 13.09.2014, 11.08.2014 and 24.02.2014 and if necessary conducting and enquiring as per the law and pass such other order or orders."

As the petitioner's representations dated 24.02.2014, 11.08.2014 and 13.09.2014 are stated to be still pending consideration and his request for issuance of a caste certificate to the effect that he belongs to Mudiraj Community, a BC-D category, is still pending consideration, this Court sees no reason to entertain this writ petition for adjudication on merits at this stage.

The writ petition is accordingly disposed of directing the authority concerned to consider the petitioner's representations 24.02.2014, 11.08.2014 and 13.09.2014 and take appropriate action thereon in accordance with law. In the event the petitioner's request for issuance of a caste certificate is rejected, the reasons therefor shall be recorded and duly communicated to him. This exercise shall be completed expeditiously and in any event, not later than three weeks from the date of receipt of a copy of this order. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR Date:01.04.2016 GJ
