THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.19895 of 2016 ORDER:
Heard learned counsel for the petitioner as well as learned Government Pleader for Civil Supplies (Andhra Pradesh). Proceedings of the 2nd respondent Revenue Divisional Officer, dated 14.06.2016 suspending the authorization of the petitioner fair price shop dealer of Chinthalapalem Village, Jaladanki Mandal, SPSR Nellore District, mainly on the ground that there is variation in weighment (shortfall) of the essential commodities, is under challenge.
Since the allegations levelled against the petitioner are serious in nature, the truth or otherwise of the same can be ascertained only in the inquiry to be conducted by the respondent-authorities. Hence, without going into the merits of the matter, it would suffice if a direction is given to the respondent authorities to complete the inquiry within a fixed timeframe.
The respondent authorities are therefore, directed to conduct and complete the inquiry and pass appropriate final orders within a period of six weeks from the date of receipt of a copy of this order, after considering the explanation, if any of the petitioner, strictly observing the principles of natural justice. If the inquiry is not completed, as aforesaid, the order of suspension dated 14.06.2016 shall stand suspended till the 2nd respondent decides the inquiry. With this order, the Writ Petition stands disposed of. No costs. Consequently, the Miscellaneous Applications, if any shall also stand disposed of.
