Heard counsel for petitioner and Sri R.Vinod Reddy, Standing Counsel appearing for respondents 2 to 4. 2.
Petitioner has filed this Writ Petition assailing the order dt.04.06.2018 of the 4th respondent demanding a sum of Rs.2,66,367/- as provisionally assessed electricity consumption charges in regard to the petitioner's service connection on the ground that in an inspection held on 24.05.2018 theft of electricity was discovered. 3.
Petitioner however disputes the same.

Since the determination of civil liability is to be done by the Special Court under Section 154(5) of the Electricity Act, 2003 (for short 'the Act') and since the petitioner has paid 1⁄4 of the provisionally assessed amount on 18.06.2018, the service connection of the petitioner is directed to be restored by the respondents.

The respondents are further directed to refer the matter to Special Court for determination of civil liability under Section 154(5) of the Act and shall not disconnect the power supply to the petitioner pending such determination of civil liability by the Special Court.

The Writ Petition is disposed of with the above directions. No order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
