HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No:4313 OF 2014 ORDER:

1. This writ petition is filed by the petitioners challenging the notice in proceedings vide Rc.No.3806/2008-MACS, dated 27.1.2014 issued by the 2nd respondent, whereby the 3rd respondent was appointed to convene a General Body meeting for the 4th respondent-society so as to conduct elections for the office bearers of the 4th respondent-society.

2. The 1st petitioner is the founder member of the 4th respondent-society and the 2nd petitioner is the member of the society. It is the case of the petitioners that if the general body is allowed to conduct a meeting on 15.2.2014, a great prejudice would be caused to the promoters, members and also to 750 Government Drivers.

3. Heard and perused the material available on record.

4. The present writ petition was filed in the year 2014. No interim order was passed by this Court in favour of the petitioners. In the proceedings impugned, it is stated as follows:

"Sri N. Sridhar, Assistant Registrar/Sub-Divisional Co-operative Officer, Khairatabad Mandal is appointed as Convener of the General Body on the said date and time and communicate the list of members chosen by the General Body to constitute ad hoc committee. He shall communicate the meeting date, venue and time of convening of Special General Body to all the members to enable them to participate in the meeting."

From the proceedings impugned, it is evident that it is only information given to the members. The meeting might have been conducted by this time. No evidence has been placed before this Court to show as to

whether any election was conducted or not. Considering the facts and circumstances of the case, this Court is of the view that nothing survives for adjudication in this writ petition.

5. Accordingly, the Writ Petition is disposed of as infructuous. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
