In view of the fact that the interim relief and the main relief in the writ petition are one and the same, the main writ petition itself is taken up for disposal, at the stage of admission, with the consent of both the parties.
The petitioners claim to be the owners and possessors of land in Sy.Nos.443 to 446/1 and 443 to 446/2 admeasuring an extent of Ac.2.85 cents, Ac.1.42 cents Ac.4.78 cents and Ac.0.55 cents respectively, situated at Enukurthi Village and post, podalakuru Mandal, SPSR Nellore District. They allege that the 4th respondentTahsildar, Podalakur Mandal proposed to conduct survey of the lands of the petitioners at the instance of respondents 5 to 7, without issuing any notice and without following due process of law. Hence they filed the present writ petition.
Heard learned counsel for the petitioners and learned Assistant Government Pleader for Revenue (A.P.) for respondents. Considering the limited relief sought for by the petitioners, without expressing any opinion on the merits of the case, this writ petition is disposed of directing the 4th respondent not to conduct any survey of the lands in question without putting the petitioners on notice and without specifying the purpose for which the land is sought to be surveyed. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed.
