This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of sri MADAS BHARATH CHANDRA, Advocate for the Petitioner and the Public Prosecutor on behalf of the Respondent No.1 and None Appeard for the Respondent No. 2 The Court made the following: ORDER
THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12299 OF 2023 ORDER:
1.
This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused seeking bail in the event of her arrest in connection with unregistered Crime for the alleged offence under Section 42O of lPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner is apprehending arrest on the ground that de-facto complainant gave donation of Rs.20,OO,000/- to the Educational Society run by this petitioner. She further obtained a loan of Rs.9,0O,OO0/ - from the de-facto complainant and towards the said amount outstanding, two cheques were also given by her. Presently, the Police are ] \ ,I continuously calling her to the Police Station, for which reason, she is apprehending arrest.

On instructions, learned Additional public prosecutor would submit that the Police have not received any complaint nor any complaint is registered.

In the said circumstances, the apprehension of petitioner is unfounded. However, if any offence is registered against the petitioner punishable upto 7 years, the police are directed to follow the procedure laid down under Section 4l-A Cr.P.C and also the guidelines formulated by the Hon,ble Supreme Court in Arnesrl- Kumar a. State of Biharr scrupulously. The petitioner shall co-operate with the Investigating Officer and shall appear before the Investigating officer as and when required for the purpose of investigation. 6.
With the said observation, the Criminal Petition is disposed off. Miscellaneous applications, if any pending in this { criminal petition, shall stand closed.
