O R D E R

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home for the respondents and at their request, the matter is being disposed of at the stage of admission. Aggrieved by the action of the respondents in summoning the petitioners to the 3rd respondent - Station House Officer, Epuru Police Station, Epuru, Guntur District, and detaining hours together without there being a crime registered, the present writ petition is filed. From the writ averments, it could be seen that the claim of the petitioner is that their father and his brothers were having certain property at Kuchenapalli village, which comes under the jurisdiction of Epuru Police Station, which was disposed of about forty years back.

Now one person by name Nookala Ravi Kumar claiming himself to be the grandson of their grandfather's brother, is claiming the property and in pursuance of his claim, the 3rd respondent - Station House Officer, Epuru Police Station, is summoning the petitioners to the police station and harassing them by detaining them hours together. Hence the writ petition. Learned Assistant Government Pleader appearing for respondents 1 to 3, on instructions, stated that respondent No. 3 is not summoning the petitioners to the police station and the allegations made are false. Recording the said statement and having regard to the fact that no crime is pending against the petitioners as on today, the respondents are directed not to summon the petitioners to police station without following due process of law.

. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs. AVS ---------------------------
