THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY Crl.P.MP.No.13031 of 2016 In/AND COMMON ORDER:

Crl.P.M.P.No.13031 of 2016 is filed under Section 320 r/w 482 Cr.P.C. seeking leave of this Court to compound the offences in view of the settlement of disputes due to interventions of the elders.

2. The offences alleged to have committed by the petitioner are under Sections 120(b), 406, 418, 420, 506 r/w 34 of IPC. 3.

Both the parties are present-in-person and they are identified by their respective counsel and the parties are also produced photostat copies of Aadhar Cards in proof of their identity. On enquiry, both the petitioner stated that he entered into compromise with respondent and the both decided to withdraw the complainants filed against one another and the petitioner paid the disputed amount to the respondent so as to lead peaceful life in future. Even if, trial is continued, the chances of supporting the prosecution case by listed witnesses are bleak and such trial would in futility.

Having considered the facts and circumstances of the case and in view of the judgment of the Apex Court in Gian Singh v. State of Punjab and another1 it is a fit case to grant permission to 1 (2012) 10 SCC 303

MSM,J compound the offences as it would not have any impact on the society.

Accordingly, Crl.P.M.P.No.13031 of 2016 is allowed.

6. In view of the orders passed in Crl.P.M.P.No.13031 of 2016, the proceedings in FIR No.413 of 2014 on the file of Chaitanyapuri Police Station, Cyberabad, are quashed. Accordingly, Crl.P.No.16006 of 2014 is allowed.

Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
