THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.NO.29714 OF 2018 ORDER:

This writ petition is filed under Article 226 of the Constitution to declare the action of respondents in opening the Rowdy Sheet C.No.1501/ACP.CZ/2014, dated 16-06-2014, against the petitioner, as illegal, arbitrary and violative of A.P. Police Standing Order 742 and contrary to the principles of natural justice and consequently direct the respondents 1 and 2 to close the said rowdy sheet in the interest of justice.

Learned counsel for the petitioner submits that this Court in similar facts and circumstances in W.P.No.4688 of 2012, dated 16.03.2017, relying on other judgments of this Court, gave liberty to the petitioner to file explanation/representation within two weeks from the date of the said order and the competent authority was directed to examine the same and pass appropriate orders. Learned counsel submits that since the criminal cases registered against the petitioner ended in acquittal or compounded, similar relief be granted to the petitioner.

Learned Assistant Government Pleader for Home, does not dispute the same.

Having regard to the facts and circumstances of the case and the submissions of the learned counsel, it is open for the petitioner to make representation to the respondents in that behalf and on such a representation being filed by the petitioner, within a period

of two weeks from the date of receipt of a copy of this order, the respondents are directed to examine the same in the light of the law laid down by this Court in W.P.No.4688 of 2012, which was disposed of on 16.03.2017 and in the judgments reported in SUNKARA SATYANARAYANA v. STATE OF ANDHRA PRADESH1 and B.SATYANARAYANA REDDY v. STATE OF ANDHRA PRADESH2, and dispose of the same in accordance with law, within a period of two months from the date of receipt of representation of the petitioner.

The writ petition is disposed of with the above directions. Interlocutory applications pending, if any, shall stand closed. No costs.
