THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12244 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.196 of 2023 on the file of Maddirala Police Station, Suryapet District, registered for the offences under Section 143, 147, 148, 447, 427, 452, 384, 324, 354, 307, 120b, 504 and 506 r/w. 149 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

A complaint was lodged alleging that this petitioner and 16 others have attacked the victim and caused injuries on account of property disputes in between A-1 and the victim. 4.
Earlier this Court by order dated 29.11.2023 refused to grant bail to the petitioner on the ground that he was involved in the offence under Section 302 of IPC. However, learned counsel for the petitioner submits that the said case was ended in acquittal even prior to the refusal of bail by this Court. The said
acquittal is not disputed by the learned Additional Public Prosecutor.

Since, other accused/A-5 to A-8 and A-12 to A-17 who are standing on the same footing were enlarged on bail, this Court deems it appropriate to direct the release of this petitioner on bail, subject to following conditions:- i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of the Judicial First Class Magistrate, Thungathurthy.
ii) The petitioner/Accused No.3 after release shall appear before the concerned Station House Officer everyday at 10:00 a.m. for a period of two weeks for the purpose of investigation and thereafter, as and when required. iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C. 6.
Accordingly, this Criminal Petition is allowed.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
