THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4335 of 2016 ORDER:
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit the petitioner herein pray that this Hon'ble Court may be pleased to issue an order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents 2 and 3 in not registering crime basing on the complaint dt.15-01-2016 lodged by the 4th respondent and the inaction of the 4th respondent in not pursuing the complaint lodged by him as illegal, arbitrary and contrary to the fundamental principles enshrined in the Constitution of India and consequently direct the 3rd respondent to forthwith register crime basing on the complaint dt. 15-012016 lodged by the 4th respondent and investigate into the matter and file final report and pass such other order or orders."
Admittedly, the complaint dated 15.01.2016 upon which the petitioner seeks action to be taken was not made by him. In that view of the matter, the writ petition is dismissed. However, it shall be open to the petitioner to make a complaint independently to the police authorities concerned, if he has any grievance with regard to commission of any offence. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
