THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.12246 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/A4 and A5 seeking anticipatory bail in the event of their arrest in connection with Crime No.396 of 2023 of Musheerabad Police Station, Hyderabad, registered for the offences punishable under Sections 307 and 427 r/w 34 of IPC.

Heard learned counsel for the petitioners/A4 and A5, learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel for the petitioners would submit that this Court granted bail to A6 and A7 in the subject crime vide order, dated 02.11.2023 in Crl.P.No.10708 of 2023 and the petitioners also stand on the same footing as that of A6 and A7 and ultimately prayed to grant bail to the petitioners.

On the other hand, learned Additional Public Prosecutor opposed to grant bail to the petitioners.

Since A6 and A7 in the subject crime were granted bail by this Court, this Court deems it appropriate to grant anticipatory bail to the petitioners/A4 and A5 also subject to the following conditions:

1) The petitioners/A4 and A5 are directed to surrender before the Station House Officer, Musheerabad Police Station, Hyderabad, within a period of seven days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/A4 and A5 on bail, on their executing personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with one surety for a like sum each to his satisfaction.

2) On such release, the petitioners/A4 and A5 shall appear before the concerned Station House Officer, as and when required for the purpose of investigation.

3) The petitioners/A4 and A5 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
