Amalapuram Advocates Bar Association, v. The State Of A.P.,
THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.20904 OF 2012 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue an order or orders, direction or directions, writ or writs particularly in the nature of "WRIT OF MANDAMUS" to declare the action of the respondents to demolishing the existing building of the Amalapuram Advocates Bar Association without providing alternative accommodation, without giving opportunity and notice is illegal, arbitrary, against the principles of natural justice."
2. Counter affidavit is filed by the Executive Engineer (R&B), Amalapuram and in the said counter, at Paragraph No.6, it is stated as follows:
"It is submitted that the Executive Engineer inspected the site along with the Dy.Executive Engineer (R&B), Amalapuram and Assistant Executive Engineer (R&B), Amalapuram on 17.02.2012. The proposal submitted by the Bar Association endorsed by the II Additional District and Sessions Judge, Amalapuram, is examined and it is observed that a site of 30'-0"/ 56'-0" is available for proposed construction of Bar Association Hall in the old Court Building near Cotton statue."
3. In reply to the said counter, reply affidavit is filed by the writ petitioner and at Paragraph No.3, it is stated that the Bar Association is ready to accept the site shown by the 4th respondent for construction of Bar Association Building.
4. While referring to the above Paragraph No.6 of the Counter affidavit filed by the Executive Engineer (R&B), Amalapuram and Paragraph No.3 of the reply affidavit of the writ petitioner, it is stated by the learned counsel for the petitioner that in view of the same, the
present writ petition can be closed.
5. Accordingly, the Writ Petition is closed. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
