When the matter is taken up for hearing, it is noticed that the writ petition against the 3rd respondent-workman was dismissed for default, vide court order, dated 30.12.2010, and thereafter the petitioner has not taken any steps to see that the writ petition is restored against the 3rd respondent. In the absence of the 3rd respondent, this writ petition cannot be adjudicated on merits. Accordingly, the writ petition is dismissed.

Miscellaneous petitions pending, if any, shall stand closed. No costs.
