HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY Civil Revision Petition No.5344 OF 2015 ORDER :

This Civil Revision Petition is filed against the docket order dated 25.08.2015, passed by the Senior Civil Judge, Atmakur, Kurnool District, in OS.No.46 of 2014.

Learned counsel for the petitioners states that when PW1 was examined the Court below has marked unregistered partition deed dated 31.05.2008 as Ex.A12, which is not admissible in evidence.

At the time of argument, the evidence of PW1 is not produced before this Court to show that Ex.A12 is marked and it is not stated in the grounds of the CRP that objection is taken at the time of marking the document. In the absence of the same, correctness of the order cannot be examined. In view of the same, the CRP is dismissed. However, it is open for the petitioners to institute fresh CRP after filing necessary document which is being challenged. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the CRP, shall stand closed.
