HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 29687 of 2018 ORDER:

The present writ petition came to be filed seeking a writ of mandamus declaring the action of the respondents in not issuing the pattadar pass book in the name of the petitioner after recent land purification program regarding the land extent Ac.2.20 gts., in Sy.Nos. 457 situated in Iskilla Village, Ramannapet Mandal, Yadadri Bhuvanagiri District, as illegal, arbitrary and unconstitutional, and consequently direct the respondents No.2 to 4 to issue pattadar pass book by considering the petitioner's representation dated 28.05.2018.

The learned Government Pleader for Revenue would submit that the appropriate authority to issue pattadar passbooks is the Tahsildar and since no application is made to the Tahsildar, the request of the petitioner cannot be considered.

Having regard to the facts and circumstances of the case, the present writ petition is disposed of with consent, at the admission stage, directing the petitioner to make an appropriate application before the concerned Tahsildar, enclosing all the relevant documents, showing her right/ title over the schedule property, and thereafter, the Tahsildar

shall deal with the said application, after hearing the petitioner, if necessary, and pass appropriate orders in accordance with law, at the earliest. There shall be no order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
