THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE Dr. JUSTI CE SHAMEEM AKTHER WRI T PETI TI ON No.20012 of 2005 ORDER: (per SK,J) This writ petition was filed by a third party to L.G.C.No.95 of 1999 on the file of the Special Court under the Andhra Pradesh Land Grabbing (Prohibition) Act, 1982, Hyderabad, after obtaining leave from this Court. The said L.G.C. was filed by G.Balamma and Smt.C.Kantamma, respondents 4 and 5 herein, and by the order under challenge, the Special Court allowed their application declaring respondents 1 and 2 therein as land grabbers and directing delivery of vacant possession of the application schedule land to them.

Significantly, this writ petition was dismissed for default against G.Balamma and Smt.C.Kantamma in addition to others as long back as on 18.06.2011 by giving effect to the order dated 18.04.2011 passed by this Court. In effect, the writ petition stands dismissed as against the applicants in L.G.C.No.95 of 1999. That being so, the validity of the order passed in the said L.G.C. cannot be adjudicated in their absence. The writ petition shall therefore stand dismissed in its entirety. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
