THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T PETI TI ON No.30070 OF 2018 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying Affidavit, it is therefore, prayed that this Hon'ble High Court may be pleased to grant appropriate relief more in the nature of Writ of Mandamus under Article 226 of the Constitution of India declaring the action of the 1st Respondent in posting OA No.1607/2018 and OA No.1608/2018 before the Court presided over by the Hon'ble Chairman instead of posting before any other Bench in considering and disposing of the request made by the Petitioner's Counsel by letter dt. 09.08.

2018 as arbitrary, illegal and unconstitutional violating Article of the Constitution of India apart from violating principles of natural justice including principle that justice not only to be done but also appears to have been done and issue consequential directions directing the 1st Respondent to forthwith post the OA No.1607/2018 and OA No.1608/2018 filed by the Petitioner through Petitioner's Counsel and all other cases of the Petitioner filed by the Petitioner through the Petitioner's Counsel before any Bench other than the Bench presided over by the Hon'ble Chairman in considering the request made by the Petitioner's Counsel dt. 09.08.2018 as well as the request made earlier and pass such other order or orders as this Hon'ble Court deems fit and proper in the circumstances of the case."

The direction sought is to consider the petitioner's representation made through counsel on 09.08.2018 for posting of the O.As. before any other Bench. Such a representation is not based on any right vesting in the petitioner to have his case heard by a particular Bench. That being so, we are not inclined to entertain this writ petition.
