THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.1303 of 2013 ORDER:

This Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the orders dated 06.05.2013 passed in Crl.M.P.No.4539 of 2012 in C.C.No.328 of 2011 on the file of the Court of the II Additional Judicial Magistrate of First Class, Machilipatnam. Heard the learned counsel for both parties.

The learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the criminal revision case with liberty to avail the remedies available to them under law.

He further submitted that the presence of the petitioners before the trial Court may be dispensed with. Permission is granted.

Petitioner No.1 is the brother and petitioner No.2 is the sister-in-law of accused No.1. There is no dispute with regard to the identity of the petitioners. Even if their presence is dispensed with, no prejudice will be caused to the second respondent. Hence, the Criminal Revision Case is dismissed as withdrawn granting liberty as prayed for. The presence of the petitioners, who are accused Nos.5 and 6 in C.C.No.328 of 2011, before the trial Court is hereby dispensed with on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Revision Case shall stand closed.
