ORAL ORDER:

This Court by order dated 9.7.2010 suspended the charge sheet and impugned suspension order. In pursuant to the interim orders of this Court, petitioner was reinstated to duty, continued in service until he attained the age of superannuation. Learned counsel for petitioner submitted that after retirement, petitioner died and his legal representatives intend to come on record.

Since, grievance of the petitioner was against suspension from service and the charge sheet and the said orders having been suspended; petitioner was reinstated; and continued in service, cause in the writ petition does not survive for prosecution by legal representatives. Further, writ petition abates on the death of sole petitioner. However, it is left open to the legal representatives of the petitioner to claim appropriate relief to which they are entitled from the employer. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
