HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.6731 of 2017 ORDER :

Heard learned counsel for the petitioner/ A1 and learned Public Prosecutor representing the State. The learned Magistrate ought to have issued the D.N.A.report to the petitioner/ A1 to make out his defence and rejection of the Copy Application by the learned Magistrate on the ground that unless the said document is marked, the petitioner is not entitled to the certified copy, is not tenable.

Having regard to the above, this Criminal petition is allowed, directing the learned Magistrate to issue certified copy of the D.N.A. report to the petitioner/ A1. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
