The petitioner/wife seeks transfer of O.P.No.394 of 2018 from the Court of the Hon'ble Judge, Family Court, City Civil Court, Hyderabad, to the Court of the Senior Civil Judge, Tadepalligudem, West Godavari District. The said O.P., was filed by the respondent/husband. 3.

The plea of the petitioner/wife is that she lives at her parents' house near Tadepalligudem, that she filed a complaint for the offence under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, at Eluru, West Godavari District, and that she also filed M.C.Case No.10 of 2018 before the Court of the Additional Judicial First Class Magistrate, Tadepalligudem. The respondent filed O.P.No.394 of 2018 before the Family Court, City Civil Courts, Hyderabad. It is also her further plea that there is a threat of apprehension if she comes to attend the Court at Hyderabad.

On the totality of the facts and circumstances of the case, I am satisfied that there is sufficient ground to accede to the request of the petitioner/wife.

In the result, this Transfer Civil Miscellaneous Petition is allowed transferring O.P.No.394 of 2018 from the Court of the Hon'ble Judge, Family Court, City Civil Court, Hyderabad, to the Court of the Senior Civil Judge, Tadepalligudem, West Godavari District Court.
