THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.745 OF 2016 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner states that originally her husband was absolute owner and occupier of the lands admeasuring Ac.0.17 guntas in Survey No.86, Ac.0.16 guntas in Survey No.90, Ac.0.16 guntas in Survey No.92 of Sabitanagar Village, Manchal Mandal, Ranga Reddy District. During the life time of the petitioner's husband, he obtained a declaratory decree dated 24.07.1977 in O.S.No.43 of 1977 passed by the Munsif Magistrate, Ibrahimpatnam, Ranga Reddy District for correction of revenue records. It is stated that during the life time of the petitioner's husband, he made several applications to the 3rd respondent for correction of revenue records, but no action was taken. Therefore, her husband filed W.P.No.1529 of 2009 before this Court, which was disposed of on 02.02.

2009 directing the 3rd respondent to take up the matter for mutation and that during the pendency of the enquiry, the petitioner's husband died on 07.03.2013. Being legal heir of the deceased, the petitioner made an application on 23.08.2015, under Form VI-A of the Andhra Pradesh Rights in Land and Pattadar Passbooks Act, 1971 (for short, 'the Act') for effecting mutation and grant of pattadar passbook and title deeds by paying requisite fee. Alleging that no action is taken by the 3rd respondent, the present Writ Petition is filed.

In view of the fact that the proceedings under Form VI-A of the Act are required to be considered in a time span of 45 days, the 3rd respondent is directed to consider the petitioner's application, dated 23.08.2015, and pass appropriate orders expeditiously, preferably within a period of four weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no

order as to costs.

Miscellaneous petitions, if any, pending in the writ petition shall stand closed.
