WRIT PETITION NO. 20463 OF 2014 O R D E R :
The petitioner prays for mandamus declaring the action of the respondents in appointing another Fair Price Shop Dealer at Karankota [General] village, Tandur Mandal, Ranga Reddy district by bifurcating the Fair Price Shop as illegal, arbitrary and contrary to applicable Government Orders.
2. Learned counsel appearing for the petitioner by placing reliance upon the averments in the counter-affidavit that the respondents are yet to finalise the division of existing card holders of subject Fair Price Shop, to both the dealers, requests the court to permit the petitioner to represent to second respondent for equal and fair distribution of cards in accordance with extant Government Orders and the second respondent may be directed to consider and pass appropriate orders.
3. The Assistant Government Pleader admits that there is slight change in the guidelines issued by the Government while divding Fair Price Shop into more than one.
4. Having regard to the above circumstances, I am satisfied that the writ petition can be disposed of by this order.
5. The petitioner is given liberty to file representation for fair distribution of cards in accordance with the extant Government Orders within four weeks from the date of receipt of a copy of this order. The second respondent on receipt of such representation re-examines and passes appropriate orders within four weeks thereafter and communicate the same to the petitioner. The interim order granted on 25/7/2014 shall remain in force till a decision is taken and communicated to the petitioner.
6. The writ petition is disposed of with the above observation. No costs.
7. As a sequel, miscellaneous petitions if any, pending in this Writ Petition shall stand closed.
