THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.27663 of 2013 ORDER:

Heard Sri M.Koteswara Rao for petitioner, the Assistant Government Pleader (Home) for respondents 1 to 3 and Sri Mastan Naidu Cherukuri for respondents 4 and 5. The petitioner prays for Mandamus declaring the inaction of respondents 1 to 3 in enquiring into and taking steps on the complaint dated 11-09-2013 submitted by petitioner as illegal, arbitrary and unc onstitutional.

With the assistance of Sri Koteswara Rao, I have carefully examined the complaint dated 11-09-2013 made by petitioner against respondents 4 and 5.

This Court is of the view that, if the petitioner has made a complaint before the jurisdictional police station against the ac ts adverted to in the complaint, and in spite of receiving information/ complaint from the petitioner, the jurisdictional police station does not look into the complaint, appropriate directions can be issued. For the reasons best known, the petitioner is pursuing the soft handling. If for a while it is assumed that respondents 4 and 5 have threatened the petitioner with dire consequences, the petitioner need not be advised by this

Court that the remedy is by filing an FIR but not sending a report to 2nd respondent.

After perusing the material available on record and hearing the learned counsel, I am satisfied no case for exercising the jurisdiction of this Court is made out.

The writ petition fails and is accordingly dismissed. No order as to costs.
