THE HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No.21866 of 2015 ORDER:

Heard the learned counsel for the petitioner and none appeared for the second respondent.

The learned counsel for the petitioner submits that he served the papers on the learned counsel for the second respondent and also intimated the fact of filing the present wit petition. In view of urgency in the matter, this Court is inclined to dispose of the matter at the admission stage. The case of the petitioner is that the petitioner made an application on 10.10.2014 before the third respondent requesting for permission for Ramzaan Eid and Bakreed prayers in the NTR Stadium, which may be held on one day between 14.07.2015 - 17.07.2015 and 23.09.2015 - 26.09.2015 respectively. When he came to know that the control of the land was handed over to the second respondent, the petitioner submitted another application before the second respondent on 26.06.2015 for conducting Ramzaan Eid prayer scheduled on 18.07.2015 or 19.07.2015.

The said application was rejected on the ground that since PIL No.125 of 2015 is pending in this Court and it may not be possible to give direction for any programme/event for the present. The learned counsel for the petitioner brought to the notice of this Court that permission was granted earlier by the third respondent on 16.01.2015 for Bakreed prayer subject to certain conditions. The petitioner is willing to comply with the conditions that may be imposed by the second respondent and pay necessary rent/fee as demanded by the second respondent. It is also submitted by the learned counsel for the petitioner that PIL No.

objecting to handing over of the land to the second respondent by the third respondent and it has nothing to do with the permission to be granted in respect of the present occasion. The ground of the second respondent in NTR stadium is vacant as on today and is fit for conducting prayers. The learned counsel for the petitioner also submits that on earlier occasions, the ground was allowed for the purpose of Hindu religious congregations and exhibitions.

In view of the facts and circumstances, the second respondent is directed to consider the application of the petitioner dated 26.06.2015 and pass necessary orders by imposing necessary conditions immediately after receipt of a copy of this order.

With the above directions, the writ petition is disposed of. Miscellaneous Petitions, if any pending in this writ petition shall stand closed. No order as to costs.
