The disciplinary authority imposed punishment of reversion from the IV Category to V Category with effect from 15.11.2016 and treating the period of suspension as Earned leave available to his credit and the balance period as leave without pay and allowances. Aggrieved by the said order of punishment, petitioner preferred appeal before the President, District Cooperative Central Bank on 03.12.2016. Alleging inaction on the part of the appellate authority in acting on appeal filed by the petitioner, this writ petition is filed.

On perusing the material placed on record it is seen that no proof is filed by the petitioner to show that an appeal was preferred by him and the same is not disposed of.

Learned counsel for the petitioner contends that the appeal is not disposed of without any justification. 5.

Having regard to these submissions and since petitioner claims that appeal is pending, the writ petition is disposed of without expressing any opinion on merits directing the appellate authority to pass orders in appeal preferred by the petitioner, if such appeal is received and pending. If the appeal is received and pending, appropriate orders shall be passed within a period of two

(2) months from the date of receipt of copy of this order. There shall be no order as to costs.

- 3 - Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
