HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY AND HON'BLE SRI JUSTICE G.SHYAM PRASAD Writ Appeal No.1012 of 2016 Date:13.10.2016 Between:

The Executive Engineer, Marketing Department, Warangal and another.

..... Appellants And:

K.Srinivas, S/o Sambaiah and another.

....Respondents Counsel for the appellants: AGP for Agriculture & Co-Operation (TS) Counsel for respondent No.1: Mr. P.Sridhar Rao Counsel for respondent No.2: GP for Labour (TS) The Court made the following:

CVNR, J & GSP, J WA.No.1012 of 2016 Dt:13.10.2016 JUDGMENT: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Writ Appeal arises out of common order, dated 30.7.2015, in Writ Petition No.23452 of 2000, whereby the learned single Judge has dismissed the said Writ Petition filed by the appellants against the award, dated 06.4.2000, in I.D.No.169 of 1996 on the file of respondent No.2. We have heard the learned Assistant Government Pleader for Agriculture & Co-Operation (Telangana State) appearing for the appellants and perused the record.

The only point argued by the learned Assistant Government Pleader is that the learned single Judge has committed an error in awarding back wages to respondent No.1. He has, however, fairly conceded that Writ Petition No.23452 of 2000 was filed by the appellants questioning the award of the Labour Court to the extent of directing reinstatement of respondent No.1 as a fresh workman and therefore, it did not involve the question of back wages.

In the light of this fact and the further fact that the merits relating to Writ Petition No.23452 of 2000, which were confined only to reinstatement of the workman, have not been argued, we have no reason to interfere with the order of the learned single Judge. The Writ Appeal is, accordingly, dismissed.

CVNR, J & GSP, J WA.No.1012 of 2016 Dt:13.10.2016 As a sequel to dismissal of the Writ Appeal, WAMP.No.2256 of 2016 filed by the appellants for interim relief is dismissed as infructuous.
