THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35678 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondent in not considering the representations, dated 22.09.2016 and 04.10.2016 made by the petitioner seeking to withdraw the blacklisting proceedings in Ref.VSP/WK/WC/16/1077, dated 27.07.2016 issued by the respondent terminating the contracts in operation in Visakhapatnam Steel Plant pertaining to the petitioner firm and blacklisting the petitioner firm for a period of five years, with effect from 23.07.2016 as illegal and arbitrary and consequently, to direct the respondent to consider the representations of the petitioner and to release the amounts for the works done by the petitioner firm and continue the petitioner firm to complete the work orders allotted to the petitioner firm.

Heard and perused the material.

Learned counsel for the petitioner submits that the respondent issued proceedings, dated 27.07.2016, terminating all the contracts of the petitioner with the respondent and also blacklisted the petitioner from entering into any business with the respondent for a period of five years. He further submits that the petitioner has made representations to the respondents, but the respondent has not passed any order disposing of the said representations. Considering the facts and circumstances of the case, the respondent is directed to dispose of the representations, dated 22.09.2016 and 04.10.2016 as early as possible, preferably within a period of two months from the date of receipt of copy of this order.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 24.10.2016 pln
