THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.15502 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondent No.1 in implicating the petitioner at this stage as one of the accused in Crime No.418/2010 on the file of Machavaram Police Station, Vijayawada City, Krishna District, even though the allegation in the complaint is time barred in terms of section 468 Cr.P.C. and consequently issuing the notice u/s.41-A Cr.P.C. directing the petitioner to appear before the 1st respondent for purpose of enquiry as arbitrary, illegal and violation of article 21 of the Constitution of India in the interest of justice." 2 . When the matter is called today, learned counsel for the 3rd respondent has submitted that charge sheet vide C.C.No.464/2015, U/s.420, 406, 506 read with 34 IPC in Crime No.418/2010, has been filed, wherein the petitioner herein is shown as accused in Crime No.418/2010, on the file of I Additional Chief Metropolitan Magistrate, Vijayawada.

3. In view of the above, the issue in the present writ petition needs no further adjudication. Therefore, the writ petition is closed.

4. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 03rd August, 2015 ss
